MEMBERSHIP AGREEMENT
1. Parties

(Hereinafter, it will be referred to as "Wordismo" in this agreement).
PARTY(B) Member who is a Wordismo application user
(Hereinafter, it will be referred to as "Member" in this agreement.)

2. Subject of the Contract
The subject of this Agreement is to determine the terms of use and service procurement conditions of the member from the Wordismo application, which is an English vocabulary learning application.

3. Definitions
3.1. Application: The mobile application named Wordismo refers to the mobile application software running on all mobile devices and all virtual reality channels where the products and services created in connection with this software are offered. (Hereinafter referred to as "Application" in this agreement.)
3.2. User: Refers to the people who benefit from the application, the website linked to the application and the services offered by Wordismo, within the conditions specified in this contract.
3.3. System Access Tools: Refers to the information that is only available to the User, such as the user's account management page, user name, password, code, password providing access to the application.
3.4. Communication Channels: Instant notification, e-mail, sms, mms, telephone notification and other means of communication.
3.5. Service: Refers to all kinds of services within the scope of this contract made available by Wordismo through the mobile application and website.
3.6. Member: Refers to the natural and legal persons who are party to this agreement and accept the binding of the agreement by approving the agreement in digital environment in order to benefit from the Wordismo application as a user.
4. Purpose of Application
With the application, it is aimed to help learn English in a fun and easy way, and after the vocabulary study section separated by level and categories, award-winning quizzes are offered to the user. Wordismo is the sole authority for the execution of the award-winning quizzes. Weekly and monthly award winners and leaderboards are announced by Wordismo. Wordismo records regarding the exams and results are definitive evidence and are binding for all members.
5. Rights and Obligations
5.1. The member accepts that he was of legal age at the time of signing this contract, and that he is responsible if he makes an untrue statement on this matter. If it is determined that the member is underage, the membership account is suspended until proven otherwise by the member. Membership for underage users (children) can only be done through their legal representatives (parent/guardian). While the legal representative accepts that the provisions of this contract are binding for him, he is also responsible for all in-app transactions and actions of the child who is the application user. The legal representative is responsible for the supervision of the child's actions and actions as a user, and Wordismo cannot be held responsible for any damages that may arise due to these actions and actions.
5.2. The member declares and undertakes that the personal and other information provided while registering to the Wordismo application is correct before the law, and that he will immediately and immediately compensate the damages that Wordismo may incur due to the inaccuracy of this information.
5.3. The member cannot give the password determined by him to other people or organizations for accessing the Wordismo application, the right of the member to use the said password belongs to him personally. For this reason, Wordismo reserves the right to claim all kinds of compensation and other claims arising from such unauthorized use against all claims and demands that may be brought against Wordismo by third parties or authorized authorities.
5.4. The member accepts and undertakes in advance to comply with the provisions of the legal legislation and not to violate them while using the Wordismo application and the linked website. Otherwise, all legal and penal obligations to arise will bind the member completely and exclusively.
5.5. Wordismo is not responsible for unauthorized access to member data due to the negligence of the member or for possible damages to its own data arising from the member.
5.6. The member may not use the Wordismo application in any way that disrupts public order, violates general morality, disturbs and harass others, for an illegal purpose or infringes on the intellectual and industrial property rights of others. In addition, the member cannot engage in activities (spam, viruses, etc.) and actions that prevent or make it difficult for others to use the services.
5.7. In case of forgetting, losing, using an incorrect password and/or incorrectly specifying the communication channels (for example, mobile phone number) created by the member and/or in case of need, Wordismo stops instant transactions, suspends the member account, cancels the password in order to secure the information of the members. and/or has the right to change. Wordismo cannot be held responsible for any losses and delays that may arise at this point.
5.8. Wordismo records are essential for quizzes and shared results (leadership rankings) carried out in the application. Member, leaderboard and other event results can be shared on Facebook, Instagram, Twitter, etc. agrees to be published on the wordismo.com/en website and application in social media.
5.9. The member who violates one or more of the articles listed in this membership agreement will be personally liable criminally and legally for this violation and will keep Wordismo free from the legal and penal consequences of these violations.
5.10. Wordismo application and website software and design are owned by Wordismo, and copyright and/or other intellectual property rights regarding them are protected by relevant laws. These cannot be used, acquired, copied, modified, reproduced or shared by the member without permission.
5.11. The name and Internet Protocol (IP) address of the Internet service provider used by Wordismo to access the site in order to improve and develop the application and/or within the framework of legal legislation, the date and time the site was accessed, the pages accessed while on the site and the Internet address of the Web site that provides direct connection to the site. Some information may be collected. By signing this contract, the Member accepts the recording of this data.
5.12. The member declares and accepts that he/she allows product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction practices to be presented to him/her by Wordismo and all its affiliated companies within the scope of the practices in force and/or to be implemented. The member, while becoming a member of the application and / or in other ways, the personal and shopping information and shopping and / or consumer behavior information that he / she has given in the past and / or will give in the future, to be collected for the above purposes, to be shared with all companies that are affiliated with Wordismo and to be used by all companies that are affiliated with Wordismo. and declares and accepts that it allows its archiving. Unless the member notifies otherwise, he/she declares and accepts that he/she allows the data to be collected, shared with all companies affiliated with Wordismo, used and archived by Wordismo and all affiliated companies, even when his/her membership ends. The member declares and accepts that he allows Wordismo and all its affiliate companies to contact him using communication channels such as internet, telephone, SMS, e-mail, unless otherwise stated. The member declares that he/she will not claim any direct and/or indirect material and/or moral, negative and/or positive, in short, any damages due to the collection, sharing, use, archiving and accessing of the above-mentioned information, and that he will not hold Wordismo and its affiliated companies liable and accepts. This provision, which allows communication for advertising and promotion purposes, is only valid if the member gives the electronic commercial message permission under the contract.
5.13. Wordismo may use the user information in the application for member security, performance of its own obligations and for some statistical evaluations and internal audits, or for advertising and / or promotion as demographic information, classify and store them on a database, apart from the services it provides.
5.14. Wordismo takes every possible precaution to ensure that its application and website are free of viruses and similar malicious software. In addition, in order to ensure ultimate security, the user must provide his own virus protection system and provide the necessary protection.
5.15. Wordismo reserves the right to change the content of the application at any time, to suspend or terminate any service provided to the users, or to delete the user information and data registered in the Wordismo application.
5.16. Wordismo does not give any guarantee that the services it provides within the scope of the Application will be constantly active and accessible. Wordismo, especially the decisions and practices of the judiciary and other competent authorities, force majeure, situations caused by third parties, disruptions and delays caused by internet connection service providers and similar external factors, misuse, technical failures and other disruptions, software updates and construction works. cannot be held responsible for any damages and losses that may arise from delays and service interruptions caused by any other reason.
5.17. The data received and stored from the member under this agreement are hosted on servers provided by Google. (For detailed information on this subject: firebase.google.com) Server and other hardware security belongs to Google and this data is not used by Google and/or any III. Wordismo cannot be held responsible for its processing and use by the person without the consent of the Member. Wordismo does not accept any responsibility for such cases and the Member accepts and declares that he will keep Wordismo free from any damages that may arise at this point.
5.18. Wordismo does not perform a direct sales transaction within the application itself. In-app advertising, subscription or in-app sales activities carried out by web service providers such as Google Play and Apple Store are carried out within the framework of the service agreements concluded between the relevant company and the member. Wordismo is not a party to contracts regarding such service and product purchases, and no hostility can be directed against Wordismo within the scope of service and sales agreements between the Member and the relevant Company, and Wordismo cannot be held liable under any name or name.
5.19. Wordismo may limit or stop access to the service, when necessary, in order to endanger the operational security of the network, to ensure the continuity of access to the network, to prevent malfunctions that may occur in the network, software or recorded files, to prevent possible disruptions or to reduce its effect, and in other cases it deems necessary.
5.20. Wordismo can change, update or cancel the terms of the membership agreement at any time without the need for prior notice and/or warning in any form or form. Any provision changed, updated or repealed will be valid for all members at the date of publication. Continuing to use the application by the member after the notification of the change is made means that the member uses the change knowingly and by consent.
5.21. The member accepts and declares that all computer records belonging to Wordismo will be taken as the sole and real exclusive evidence and that the said records constitute a contract of evidence.
5.22. In accordance with this membership agreement, Wordismo has the authority to send informative e-mails to the registered e-mail addresses of the member and informing SMSs to their mobile phones. will be deemed to have. In case the member wishes to stop receiving mail and/or SMS, he/she will send his/her request to Wordismo with a written notification.
5.23. Notifications to be made by mail, sms and other means required by the service offered to the member through Wordismo are within the scope of the performance of this membership agreement and are not legally subject to any express permission. With the acceptance of the membership agreement, the member accepts to be contacted within the scope of the service.
5.24. For electronic commercial submissions outside the scope of the service offered by Wordismo, the express consent of the member is sought. Wordismo does not send electronic commercial messages to the member without its express permission regarding advertisements, promotions, discounts, promotions and campaigns.

6. Termination of Contract
This agreement will remain in effect until the member cancels his/her membership or until Wordismo cancels his/her membership. In the event that the member violates any provision of the membership agreement, Wordismo will be able to terminate the agreement unilaterally and without compensation by canceling the membership of the member. In the event that the application is completely removed, this membership agreement is automatically terminated.

7. Notice/Notice
Notifications made to the e-mail addresses and/or gsm number reported by the member will result in all the provisions and consequences of a legally valid notification. The obligation to notify Wordismo of any changes in the communication channels belongs to the Member.

8. Enforcement
Member registration cannot be made without a declaration of acceptance that the member has read and accepted this membership agreement. Membership registration means that the member has read all the articles in the membership agreement and accepted the articles in the membership agreement. This Agreement is concluded when the member approves the membership acceptance statement in the digital environment and enters into force in a mutually binding manner.

As the user/member of the contract, I declare that I have read and understood this membership agreement, that I want to be a member of Wordismo free of charge and use the Wordismo application and I accept the terms of the contract.
